A 27-year-old man with a disability (OKU) has been sentenced to seven days in jail and fined RM10,000 for riding a motorcycle while intoxicated.

Mohd Azrey Rhyme pleaded guilty before Magistrate Don Stiwin Malanjum for the offence committed on October 5 last year.

He was stopped at a roadblock along Jalan Chong Thien Vun, Tawau, at 11.20 pm, where a breathalyser test showed his blood alcohol level exceeded the legal limit.

He was charged under Section 45A(1) of the Road Transport Act 1987, which carries a maximum penalty of two years’ imprisonment and a fine of up to RM30,000.

Mohd Azrey also faced a separate charge under Section 26(1) of the same Act for riding without a licence and insurance coverage.

Deputy public prosecutor Assistant Superintendent Joan Lee urged the court to impose a heavy sentence as a deterrent.

The magistrate ruled that failure to pay the fine would result in an additional three-month jail term, with the accused also disqualified from holding a driving licence for two years. – February 12, 2025
