Court to decide rejection of Sabah 40% motion on Jan 26

The High Court will decide whether Chin can proceed with judicial review
The court in Kota Kinabalu to decide on whether to allow a review application on Jan 26, 2027.

The High Court here will decide on Jan 26 next year whether to allow a judicial review application by Warisan Kapayan assemblyman Chin Tek Ming over the rejection of his motion on Sabah’s 40% revenue entitlement.

The application challenges the decision by Sabah State Assembly Speaker Kadzim M Yahya to reject Chin’s private motion on the state’s constitutional entitlement to 40% of federal net revenue derived from Sabah.

The court fixed the decision date after hearing submissions from Chin, the federal and state governments, and the Speaker.

Chin said his original motion was intended to empower the Sabah government to pursue negotiations and legal action to demand payment of the entitlement for 2022 to 2025 and subsequent years.

He noted that both the state and federal governments had objected to his judicial review application, adding that neither appeared to be taking active steps to address the demand.

Chin said he hoped the court would grant the relief sought and provide a clear resolution to the dispute over Sabah’s constitutional entitlement.
